TASKS AND POWERS

1. To submit to the Provincial People’s Committee for promulgation:

a) The Working Regulation of the Provincial People’s Committee;

b) Decisions relating to fields under the management scope of the Office of the Provincial People’s Committee;
c) Decisions stipulating the functions, tasks, powers, and organizational structure of the Office of the Provincial People’s Committee and its public service units;

d) Guiding documents detailing the functions, tasks, and powers of the Offices of the People’s Councils and People’s Committees of communes, wards, and special zones under the province or centrally run city (hereinafter collectively referred to as commune-level) in office-related activities;
đ) Programs and plans relating to the professional fields of the Office of the Provincial People’s Committee;
e) Other documents as assigned by the Provincial People’s Committee.

2. To submit to the Chairman of the Provincial People’s Committee for promulgation documents under the authority of the Chairman, as assigned.

3. To advise, formulate, manage, monitor, and organize the implementation of working programs and plans of the Provincial People’s Committee:

a) Consolidate proposals from provincial departments, agencies, commune-level People’s Committees, and relevant organizations regarding program and plan development;

b) Recommend to the Chairman of the Provincial People’s Committee issues requiring focused direction and administration, or assign relevant agencies to study and develop schemes, projects, or draft documents;

c) Formulate and submit to the Provincial People’s Committee and its Chairman for promulgation or approval the working programs and plans;

d) Monitor and urge provincial departments, agencies, commune-level People’s Committees, and relevant organizations to implement working programs and plans, ensuring timeliness and quality;

đ) Periodically or extraordinarily, report on implementation results; propose solutions; promptly report and adjust programs and plans to meet management, direction, and administration requirements of the Provincial People’s Committee and its Chairman.

4. To serve the general operations of the Provincial People’s Committee:

a) Lead and coordinate with relevant agencies in preparing programs, contents, and logistics for sessions of the Provincial People’s Committee;

b) Carry out synthesis and reporting tasks;

c) Monitor, urge, and evaluate the implementation of the Working Regulation of the Provincial People’s Committee;

d) Advise and assist the Provincial People’s Committee in organizing citizen reception in accordance with current laws.

5. To advise and assist the Chairman and Vice Chairmen of the Provincial People’s Committee (hereinafter collectively referred to as the Chairman of the Provincial People’s Committee) in performing their duties and powers:

a) Advise and assist the Chairman in convening and presiding over sessions, meetings, and conferences (hereinafter collectively referred to as meetings) of the Provincial People’s Committee and its Chairman;

b) Submit to the Chairman for assigning relevant agencies to prepare contents for the Chairman to report, explain, and answer questions before the Provincial People’s Council; coordinate with relevant agencies to assist the Chairman in developing plans and contents for voter contact, settlement, and response to petitions;

c) Advise and assist the Chairman in: assigning duties among the Chairman and Vice Chairmen of the Provincial People’s Committee; monitoring, urging, and inspecting coordination among provincial departments, agencies, and commune-level People’s Committees as prescribed by law; consolidating and reporting to the Chairman issues arising in order to make timely adjustments;
d) Advise and assist the Chairman in improving working style and methods, digital transformation, and the application of information technology in direction and administration; maintain discipline and administrative order in the locality;

đ) Advise and assist the Chairman in coordinating the development of Regulations on coordination between the Provincial People’s Committee and relevant agencies and organizations in the locality;
e) Advise and assist the Chairman in implementing information and reporting regimes on a periodic or ad-hoc basis in accordance with law and as required by competent authorities;

g) Coordinate with relevant agencies to assist the Chairman in citizen reception in accordance with law and the Working Regulation of the Provincial People’s Committee;

h) Prepare programs and contents for working trips and guest receptions of the Chairman in accordance with regulations;

i) Receive, advise, and coordinate in handling issues raised by the press, in accordance with regulations and as directed by the Chairman of the Provincial People’s Committee.

6. Receiving, processing, issuing, and managing documents submitted to the Provincial People’s Committee and the Chairman of the Provincial People’s Committee; monitoring, urging, and inspecting implementation.

a) For proposals, projects, and draft documents submitted by agencies:

  • Requests for drafting legal normative documents shall be carried out in accordance with the law on the promulgation of legal normative documents;
  • For proposals, projects, and draft documents that are not legal normative documents: Review dossiers; examine procedures, forms, formats, contents, consistency, and legality of the draft; prepare submission notes and propose handling options;
  • During processing, if there are differing opinions, preside over meetings with relevant agencies/organizations to exchange and reach consensus before submission.

b) For draft reports: Coordinate with relevant agencies to edit and finalize according to the Chairman’s instructions;

c) For other documents: Recommend that the Chairman of the Provincial People’s Committee assign relevant agencies to implement or organize necessary conditions for handling in accordance with law;

d) Manage and use the official seal and cryptographic devices of the agency in accordance with law;

đ) Issue documents of the Provincial People’s Committee and the Chairman of the Provincial People’s Committee;

e) Archive documents, records, and files of the Provincial People’s Committee and its Chairman;

g) Monitor, urge, and inspect the implementation of documents of the Provincial People’s Committee and its Chairman; periodically review and report to the Chairman to ensure consistency and uniformity in direction and administration;

h) Review and summarize difficulties and issues related to authority, dossiers, procedures, and office administration in the course of direction and administration of the Provincial People’s Committee and its Chairman; promptly report for amendment/supplementation; annually report to the Government Office.

7. Implementing information management and reporting regime.

a) Organize, manage, and update information to serve the direction and administration of the Provincial People’s Committee and its Chairman; coordinate in providing information for the direction and administration of the Government and the Prime Minister;

b) Organize, manage, and publish official information on activities of the Provincial People’s Committee and its Chairman, and provide information as prescribed;

c) Develop, manage, and operate Lao Cai Portal; connect with the Government Portal;…
d) Manage and publish the provincial-level Official Gazette (electronic);

đ) Establish, manage, and maintain the information technology network of the Provincial People’s Committee;

e) Advise on the development and operation of the local reporting information system; coordinate in integrating, connecting, and sharing data with the Government reporting information system; connect the e-administration information system to serve the leadership, direction, and administration of the Provincial People’s Committee and its Chairman.

8. Advising and assisting the Provincial People’s Committee on administrative procedure control and implementing the one-stop-shop and interconnected one-stop-shop mechanism in administrative procedure settlement.

a) Guide, monitor, urge, and inspect administrative procedure control and implementation of administrative procedures in the electronic environment by agencies/organizations under the Provincial People’s Committee; synthesize and report on results as prescribed;

b) Organize the implementation of administrative procedure reform and one-stop-shop mechanisms at the local level; manage communication on administrative reform;

c) Control the quality, publish, and make public administrative procedures under the Provincial People’s Committee’s competence; control the provision of administrative procedures in the electronic environment;

d) Research, propose policies, solutions, initiatives, and replicate best practices in administrative reform; evaluate and handle review results of administrative procedures in accordance with law;

đ) Receive and process feedback and recommendations from organizations and individuals on regulations and administrative procedures under the jurisdiction of the Provincial People’s Committee and its Chairman;

e) Participate in managing and operating the National Administrative Procedures Database and National Public Service Portal; develop, manage, operate, and exploit the Provincial Administrative Procedure Information System; ensure connection, integration, and sharing of data to serve leadership, direction, and administration of the Provincial People’s Committee and its Chairman

9. Advising and assisting the Provincial People’s Committee in implementing the sending and receiving of electronic documents and processing work dossiers in the electronic environment; serving as the focal point for connecting and integrating document management and administration systems among state administrative agencies at the local level.

10. Ensuring material, technical, and logistical conditions for activities of the Provincial People’s Committee and its Chairman; ensuring IT infrastructure for the Provincial E-Portal and information systems serving direction and administration as assigned.

11. Providing professional and technical guidance.

a) Preside and coordinate with the Office of the National Assembly Delegation and the Provincial People’s Council in reviewing, guiding office administration professional practices for Offices of Departments and Offices of Commune-level People’s Councils and People’s Committees;

b) Provide professional guidance for officials in charge of administrative procedure control at the local level.

12. Managing internal administration.

a) Implement documents, plans, programs, and schemes issued or approved by competent authorities related to the Office’s activities;

b) Receive, process, issue, and manage documents of the Office of the Provincial People’s Committee;

c) Conduct international cooperation as prescribed by law and as assigned/authorized by the Provincial People’s Committee or its Chairman;

d) Organize research, application of scientific-technical advances, innovation, and digital transformation; develop information and archival systems for state management and professional activities; implement administrative reform tasks;

đ) Issue regulations on functions, duties, powers of organizations under the Office of the Provincial People’s Committee and its working regulations;

e) Manage organizational structure, staffing of civil servants, positions, professional ranks, and staff quotas in public service units under the Office;

g) Implement salary regimes, benefits, rewards, discipline, training, and professional development for officials and employees under its management;

h) Manage and be responsible for finance and assets allocated in accordance with law; guide and inspect the implementation of autonomy and accountability mechanisms for affiliated public service units.

13. Periodically or upon request, report to the Provincial People’s Committee, the Government Office, and competent authorities on the performance of assigned tasks.

14. Perform other duties and powers as decentralized or authorized by competent authorities; and as assigned by the Provincial People’s Committee or its Chairman, or as prescribed by law.
